PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PURCHASING AND USING PRODUCTS OR SERVICES FROM ALPHA BODY FITNESS LLC.

Commitment: By purchasing the ABF 30 Day Kickboxing Cardio Challenge by ALPHA BODY FITNESS LLC, the Client is making a commitment to his/her health. Clients should follow the program and instructions of the Trainer to the best of their ability to maximize their results and better achieve their goals. Remember, the ultimate results are up to the Client. The Trainer will show the Client how to work his/her muscles correctly, how to use proper form and encourage him/her to go to his/her safe limit, but the Client is the only one who can make sure he/she works out consistently, eats properly, gets plenty of sleep, and lives a healthy lifestyle. I the Client understand that there are no Fitness Assessments involved with this purchase and that I am fully responsible and aware of any health conditions that may or may not prevent me from performing any exercises within this purchase.

Specifics: Client understands that this is a 30 Day Kickboxing Cardio Challenge and that It requires a purchase before having access to the workout program. Client understands that this is an online purchase that includes video tutorials, access to online profile/account, workout documents, etc. If for any reason there are any technical issues that prevents the Client from using any of the features, they understand the Trainer nor ALPHA BODY FITNESS LLC is responsible. To perform this online fitness program Client is aware that they may choose any location, day or time of their choice and no equipment is required. Client understands that if they choose any equipment or location to perform their workouts they are fully responsible for any injuries or damage and understand that the Trainer and ALPHA BODY FITNESS LLC is not at fault nor responsible.

Length of Sessions/Scheduling: Sessions will last approximately forty-five (45) minutes. It is the Clients responsibility to follow the full program but they may opt out at any time. The ABF 30 Day Kickboxing Cardio Challenge is a 30 Day Course. The client understands that their 30 days will end on the 31st day from the day they enrolled/purchased the program. Client will get 1 additional day for a total of 31 days incase they miss a day for unforeseen circumstances. If the Client misses two or more days they understand that they will fall behind on the program and no additional days will be added on. There are no set times or days to perform the workouts of this challenge.

Equipment/Attire: Client understands that it is appropriate to wear proper attire while completing their workouts. Client understands that a timer is required to perform their workouts. No equipment is required nor provided within this purchase. Any ALPHA BODY FITNESS LLC equipment that is used should be used for the purpose of this program or fitness activities within this or any programs, trainings or private sessions.

Stopping Exercises: Client may refuse or stop any exercise for any reason. It is the Client’s responsibility to stop for any discomfort or pain arising from or during exercises, as well as, any and all other known
limitations Client has or experiences.

Payment: Payment must be made in full to receive any or purchases from ALHA BODY FITNESS LLC. Client understands that in order to purchase the online course they must pay with either debit/credit/PayPal. Payment for the ABF 30 Day Kickboxing Cardio Challenge is a one time fee per 30 days. If a Client wants to repeat the Challenge after their 31 days, they understand that a full purchase must be made. Client will receive an receipt for each purchase made.

Cancellation and Refund: Client may cancel the ABF 30 Day Kickboxing Cardio Challenge at any time. Client understands that once a purchase is made there are no refunds due to Client having full access to the program and an account being created.

Additional Cancellation/Changes: ALPHA BODY FITNESS LLC reserves the right, at any time, to modify or discontinue, temporarily or permanently, a Site License with or without notice. In addition, these Terms and any prices are subject to change at any time. ALPHA BODY FITNES LLC will attempt to give you fourteen (14) days’ prior notice of any material changes that impact your account, when possible.

Ownership: ALPHA BODY FITNESS LLC and/or its licensors own and shall retain all rights, titles, and interests, including all intellectual property rights, in and to the products, services, documentation, imagery, and content (including at www.Alphabodyfitness.com) provided under these Terms, and all elements thereof.  Except for the express licenses granted to you herein, you neither have, nor acquire, any rights, titles, or interests in or to the foregoing, or any element thereof. In addition, you acknowledge and agree that you will not bundle any ALPHA BODY FITNESS products with any other products to be distributed in online marketplaces.

Death or Disability: Should Client become unable to use or receive services under this contract due to
death or disability, Client, or Client’s estate as the case may be, may or may not be liable for any portion of the charges made to the time prior to death or the onset of disability. Trainer requires reasonable evidence of death, e.g. death certificate, or disability, e.g. doctor’s note, to be presented at the time of cancellation. Reasonable evidence
includes, but is not limited to, a doctor’s letter about the onset of disability or death certificate.

Notices: ALPHA BODY FITNESS LLC may send you email notifications from time to time related to these Terms and the subject matter. These emails may include notifications of licensing changes, changes to these Terms, Site License expiration, promotions, renewal notices and other emails related to your purchases. If ALPHA BODY FITNESS LLC receives an automated response that the email is undeliverable, these notices shall be effective upon the date it was sent to you.

Option to Repurchase: Client shall have the option to repurchase the ABF 30 Day Kickboxing Cardio Challenge once they have completed their 30 days. Client will have their previous account if and will regain access once they decide to repurchase. Client understands that a repurchase is not required and they repurchase as long as the service is avaliable.

Social/Public: You the Client agree and understand that you shall not use or exploit any ALPHA BODY FITNESS LLC names, trademarks, logos service marks, or other indicia or trade origin, or refer to ALPHA BODY FITNESS LLC directly or indirectly in any marketing materials, advertising, customer lists, media release, public announcement, or public disclosure relating to the products or services, or these Terms or its subject matter, without obtaining ALPHA BODY FITNESS LLC prior express written consent prior to each use.
